Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Kosha mobile application and related services (the "Service") provided by Quark Apps ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use the Service. By using Kosha, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Your account
You may sign in using Apple or Google. You are responsible for maintaining the security of your account and for all activity under it. Notify us promptly at support@quark-apps.com if you suspect unauthorized access.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial language learning. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service except as permitted by law.
4. Subscriptions and payments
Kosha may offer optional premium subscriptions. Payments are processed by Apple through the App Store. By subscribing, you agree to Apple's terms and payment policies.
- Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Billing: Your Apple ID account is charged at confirmation of purchase and for each renewal.
- Management: You can manage or cancel subscriptions in your Apple ID Account Settings → Subscriptions.
- Refunds: Refund requests are handled by Apple according to their policies.
Free-tier limits (e.g. daily word caps, interest limits) may apply when you are not subscribed. We may change pricing and features with notice where required by law or platform rules.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of applicable laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Scrape, harvest, or automate access beyond normal app use
- Interfere with or disrupt the Service
- Upload malicious code or content that infringes others' rights
6. Content and intellectual property
The Service, including its design, software, word content, and branding, is owned by Quark Apps or its licensors and protected by intellectual property laws. These Terms do not grant you ownership of any part of the Service.
7. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or fully accurate language content or learning outcomes.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUARK APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) EUR 50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Termination
You may stop using the Service at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate access if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.
11. Changes
We may modify these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance where permitted by law.
12. Governing law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Mandatory consumer protection laws in your country of residence remain unaffected where applicable. Disputes shall be subject to the jurisdiction of the courts of Germany, unless mandatory law requires otherwise.
